Kate To, who moved from her Fernhurst business to Midhurst in 2008, fought a hard battle to run her new restaurant, the Yen Vinh.

She was granted planning permission to change the use of Bepton House from offices to a restaurant in 2007. But she faced tough opposition when she submitted plans to add a takeaway and a two-storey extension.

200 protesters signed a petition, Midhurst town councillors objected and it was refused by Chichester District Council.

But Mrs To appealed to a government planning inspector who granted her permission on condition the takeaway closed at 10pm.

There was a further battle when she applied for permission to extend this to 11pm.

Asking for change the use to residential her consultants said: “The present owners and operators intend to retire in the near future and wish to remain in the property.”
