Brighton activist wins battle to postpone Labour disciplinary hearing

Suspended Labour member Tony Greenstein says he has won a High Court battle against the party over the timing of his disciplinary hearing last week.

Mr Greenstein from Brighton, who is a Jewish anti-Zionist, has been suspended from the party for 20 months as part of what he claims is a 'false anti-Semitism witch-hunt'.

While recovering in hospital from surgery, Mr Greenstein said he received a summons on November 2 to a disciplinary hearing on December 11.

He said Labour's National Constitutional Committee (NCC) turned down requests to postpone his hearing, leaving Mr Greenstein with little time to respond to a 189-page file on his case - he said.

Mr Greenstein filed an application for an injunction to the High Court at the Royal Courts of Justice, in an attempt to stop Labour from holding the hearing on December 11.

The High Court last week (December 7) granted the injunction preventing the Labour Party holding the meeting until January 8, 2018 at the earliest, Mr Greenstein said.

He said the High Court found 'there had been a breach of their obligation to ensure fairness’ in Labour's refusal to grant an extension.

Mr Greenstein said: "All my pleas to the Labour Party to postpone the hearing until the New Year fell on deaf ears.

"Having repeatedly leaked details of my case to the national press Iain McNicol and the Compliance Unit were determined to expedite my hearing and expel me.

"Despite being Jewish I was suspended as part of the false anti-Semitism witch-hunt in March 2016.

"I had evidence that I was being treated differently from other people who were suspended but nothing I said, despite having been in hospital recently would persuade these people to change their minds.

"It is as if they have learnt nothing from the death of Carl Sergeant.

"I would like to thank Mark MacDonald QC for his pro bono help and assistance."

A Labour Party spokesperson said: “The party takes all complaints extremely seriously. A Labour Party member has been suspended from the party pending an investigation.”
